PROFESSIONAL EXPERIENCE
Mr.
Tweddale has been an engineering and environmental consultant since 1987.
His primary areas of technical expertise include regulatory compliance,
energy management, site investigation and remediation, brownfield site
redevelopment, real estate due diligence, legal support, risk reduction,
regulatory compliance, litigation/mediation, and agency negotiations. His
primary project role is to prioritize and clarify objectives with the
client, establish the technical direction with the team, communicate
findings and risk/cost implications in a succinct and timely manner, and act
as the primary liaison with legal counsel, financiers, and regulatory
agencies, as needed.
Energy and Environmental Services
- Helped a small business obtain a
$6,800 Wisconsin tax refund and save $8,800 annually by analyzing three
years of electric and natural gas data and documenting the tax-exempt
energy consumed in manufacturing. Identified several projects to help
the manufacturer reduce energy costs in the future, including a review
of inconsistencies in the utility rate structure and the boiler
maintenance schedule.
- Identified steam losses, compressed
air leaks, inefficient motors, and outdated process controls as the
primary energy-saving opportunities at four large consumer goods
processing facilities in the southeastern United States. As part of
detailed environmental, health and safety audits, prioritized regulatory
compliance risks and recommended capital budgeting items for systemic
continual improvement.
- Determined that the 2009 USEPA
Greenhouse Gas (GHG) Mandatory Reporting Rule for General Stationary
Combustion Sources does not apply to the 30 largest facilities owned by
a major U.S. processing company, by analyzing fuel consumption records,
tabulating input ratings by equipment type, and estimating the total GHG
emissions. Also summarized potentially applicable GHG regulations from
18 states.
- Verified compliance with OSHA
regulations at a small, primary-metal manufacturer by sampling indoor
air quality following a process change.
Legal Support, Risk Reduction, and
Regulatory Compliance
- Reviewed real estate appraisal
reports, background environmental data, and government records to
prepare an expert witness report on behalf of a small business owner as
part of an eminent domain and property valuation case in Wisconsin. The
report concluded that the property’s current use and value were not
diminished by historic spills, and that the “taking” of real estate
should reflect fair market value.
- Conducted strategic environmental
health & safety audits at vendor and supplier sites across the United
States, focusing on air quality, waste handling, and compliance with
wastewater and stormwater permit conditions, including verification from
local and state government representatives on behalf of a Fortune 500
company seeking to reduce public relations and litigation risk.
- Reviewed the technical and
administrative work of another environmental consultant, prepared a
summary of opinions regarding professional negligence and malpractice,
and provided expert witness testimony during depositions on behalf of a
Fortune 500 company seeking to reduce public relations and litigation
risk.
Site Investigation and Remediation
- Developed a cost-effective
investigation and remediation strategy for a 12-acre brownfield site,
working with the Chicago Department of Environment and implementing the
Illinois Tiered Approach to Cleanup Objectives (TACO) process. Conducted
a health risk assessment and teamed with the architect and general
contractor to reduce the off-site disposal of Special Waste containing
lead, arsenic, and polynuclear aromatic hydrocarbons. Served as the
client representative during demolition and removal of a transformer
building with polychlorinated biphenyls (PCBs), and asbestos abatement
from utility tunnels.
- Closed a commingled petroleum and
chlorinated solvent case in Rock County, Wisconsin, with regulatory
oversight from the Wisconsin Department of Natural Resources (WDNR)
Remediation and Redevelopment Program, WDNR Drinking Water Bureau,
Wisconsin Department of Commerce (Commerce) Petroleum Environmental
Cleanup Fund Award (PECFA) Bureau, and the Wisconsin Department of
Justice (DOJ). Designed and supervised installation of a replacement
water supply well, maximized PECFA cost reimbursement, and minimized DOJ
forfeitures during enforcement negotiations.
Real Estate Due Diligence
- Compiled seven years of previous
Environmental Site Assessment (ESA) data, and developed a work scope to
address Phase 1 and Phase 2 ESA data gaps, as part of due diligence for
an industrial laundry facility in Chicago, Illinois. Within a tight real
estate closing schedule, developed detailed cost estimates for
environmental and geotechnical work to help the client negotiate a
favorable purchase agreement and obtain cost-cap insurance.
- Conducted all appropriate inquiry
(AAI) Phase 1 ESAs for clients acquiring or expanding businesses
throughout North America and in Puerto Rico. In addition to the American
Society for Testing and Materials (ASTM) criteria, evaluated business
concerns such as indoor air quality, wetlands, floodplains, earthquake
potential, radon, asbestos, drinking water, and geotechnical/soil
conditions.
- Summarized acquisition-related capital
and operating costs using information obtained from rapid-turn Phase 2
ESAs and regulatory compliance audits at active manufacturing sites.
Contaminant Fate and Transport
- Researched the history of chemical
releases at a Dane County solvent reclamation facility located in a
complex geologic setting with glacial deposits overlying fractured
bedrock. Reviewed data from decades of investigation and remediation
work. Prepared an affidavit regarding the timing and nature of the
releases, and provided expert witness testimony in deposition.
- Collected and plotted groundwater data
from an adjacent petroleum release site for an active gas station site
in a fractured bedrock setting, to illustrate to the state agency that
the release at the subject property could not have caused the observed
plume concentrations, resulting in closure of the subject site.
Agency and Public Interaction
- Negotiated a reduced site
investigation work scope for a chemical company in Wisconsin by
addressing WDNR concerns regarding area bedrock water supply wells and
correcting errors in the historic files. Re-focused the project
objectives on case closure.
- Coordinated efforts to locate and
sample nearby private water wells and provide temporary, alternative
water supplies to residents on behalf of the insured following a
warehouse fire at a chemical distributer.
